TERMS & CONDITIONS

These Terms & Conditions (“Terms”) govern your access to and use of YCAD’s mobile and web applications and related services (collectively, the “Service”). By creating an account or using the Service, you agree to be bound by these Terms.

 

If you do not agree, do not use YCAD.

 

“YCAD”, “we”, “us”, and “our” refer to Mikeli, 65 Alsek Rd, Whitehorse, YT, Y1A 3K3, Canada. “You” means the individual user, or the organization you represent.​

 

1. Eligibility & Accounts

​​

  • You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) to use YCAD.

  • If you create an account on behalf of a team, club, school, or organization, you represent that you are authorized to do so.

  • You are responsible for:

    • Keeping your login credentials secure

    • All activity that occurs under your account

​

If you believe your account has been compromised, you must notify us promptly at info@yukoncad.ca.​

 

2. Use of the Service & License

​

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service solely for your own coaching and training-related purposes.

 

You agree not to:

​​

  • Copy, modify, distribute, sell, or lease any part of the Service

  • Reverse engineer or attempt to extract source code, except where permitted by law

  • Bypass or attempt to bypass any security or access controls

  • Use the Service for any unlawful, abusive, or unauthorized purpose

​

We can suspend or terminate your access if you violate these Terms or misuse the Service.

3. Subscriptions, Billing & Refunds

​

Some features of YCAD require a paid subscription or in-app purchase.

 

Subscriptions and purchases are processed by Apple App Store or Google Play and managed by RevenueCat, a third-party subscription management service.

 

  • Apple App Store (iOS): Billing, renewals, and refunds are governed by Apple’s terms.

  • Google Play (if applicable): Billing and refunds are governed by Google’s terms.

 

YCAD does not collect or store your payment card details and cannot override app store refund policies.

 

RevenueCat processes limited information (such as app user identifiers and purchase status) solely to manage subscriptions, entitlements, and purchase restoration.

4. User Content

​

“User Content” means any content you create or upload in YCAD, including drills, practice plans, notes, team information, and shared content.

 

You:

​​

  • Retain ownership of your User Content

  • Grant YCAD a worldwide, non-exclusive, royalty-free license to host, store, display, and process your User Content solely to operate and improve the Service (including backups, analytics, and support)

  • Are responsible for ensuring you have the right to upload and share any content you add

 

You agree not to upload or share content that:​

 

  • Violates applicable law

  • Infringes any third party’s intellectual property, privacy, or other rights

  • Is abusive, hateful, or harassing

​

We may remove content or suspend accounts where we reasonably believe these rules are being broken.

​

AI Features & AI-Generated Content

​

YCAD uses automated artificial intelligence (“AI”) features powered by Firebase AI to assist with drill creation, warmups, practice planning, feedback, and related coaching tools. When you use these features, the text and content you provide (including drills, warmups, notes, and practice plans) may be transmitted to and processed by Firebase AI to generate responses.

 

You acknowledge and agree that:

  1. Your content is processed by AI.

    Your inputs are sent to Firebase AI for automated analysis and generation.

  2. No safety or accuracy guarantees.

    AI-generated outputs may be incorrect, incomplete, unsuitable, or unsafe for your athletes or environment. You must review all AI content before using it in real training.

  3. You remain fully responsible for use of AI content.

    YCAD does not supervise training sessions or assess athlete ability. You are solely responsible for determining whether any drill, practice plan, or recommendation—AI-generated or otherwise—is appropriate and safe.

  4. No reliance on AI for safety decisions.

    AI features are for convenience and planning only. They are not a substitute for professional coaching judgment, safety protocols, or medical advice.

  5. No training of public AI models.

    YCAD does not permit Firebase AI to use your content to train or improve Google’s public AI models. Processing is limited to operating and improving YCAD’s features.

  6. Prohibited content.

    You agree not to input sensitive personal information about athletes (e.g., medical conditions, injuries, or private data) into AI features.

 

YCAD is not liable for any harm, injury, or damages arising from your use or reliance on AI-generated content.

5. Intellectual Property

​

The Service, including its design, features, code, and branding, is owned by YCAD or our licensors and is protected by copyright and other laws.

 

Except for the limited license in Section 2, these Terms do not grant you any ownership or rights in YCAD’s intellectual property.

 

You may not use YCAD’s name, logo, or branding without our prior written consent.

6. Third-Party Services

 

YCAD integrates with third-party services such as:

​​

  • Firebase (authentication, database, analytics, crash reporting)

  • RevenueCat (subscription management and entitlement tracking)

  • App stores (Apple App Store, Google Play, etc.)

​

Those services have their own terms and privacy policies. We are not responsible for third-party services and you use them at your own risk.

​​

7. Availability, Changes & Updates

​

We may modify, update, or discontinue parts of the Service at any time.

 

We may also release updates (bug fixes, changes, new features). Updates may be required for continued use of the app. We are not obligated to maintain any specific feature set forever.

8. Disclaimers

​

YCAD is a coaching and planning tool. It does not:​

 

  • Guarantee any specific performance, training, or development outcomes

  • Replace professional coaching judgment, safety rules, or medical advice

​

You use YCAD at your own risk, and you are responsible for how you apply drills and practice plans in real life.

 

The Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including fitness for a particular purpose, non-infringement, or reliability of any particular feature or integration.

 

We do not guarantee that the Service will be:​

 

  • Error-free or uninterrupted

  • Free from security vulnerabilities

  • Compatible with every device or operating system version​

​

YCAD is not responsible for interruptions, errors, or loss of access caused by third-party services, including app store billing systems or subscription management providers.

 

9. Limitation of Liability

​

To the maximum extent permitted by law:​

 

  • YCAD and its owners, directors, employees, and contractors will not be liable for any indirect, incidental, consequential, special, or punitive damages, including loss of profits, data, or goodwill, arising out of or in connection with your use of the Service.

​

  • Our total liability for any claims relating to the Service will not exceed the greater of: 

    • ​The amount you paid to us for the Service in the last 12 months, or

    • $50 CAD

 

Some jurisdictions do not allow certain limitations or exclusions of liability; in those cases, the limitations above apply to the fullest extent permitted by law.

 

10. Indemnity

​

You agree to indemnify and hold harmless YCAD and its owners, directors, employees, and contractors from any claims, damages, losses, or expenses (including reasonable legal fees) arising from:​

 

  • Your use of the Service

  • Your User Content

  • Your violation of these Terms or of any law or third-party right​

 

11. Governing Law & Disputes

​

These Terms are governed by the laws of Yukon, Canada, and applicable federal laws of Canada, without giving effect to conflict-of-law rules.

 

Any dispute arising out of or relating to these Terms or the Service will be brought in the courts of Yukon, Canada, and you agree to the exclusive jurisdiction of those courts.

 

12. Changes to These Terms

We may update these Terms from time to time to reflect changes in the Service or applicable law.​

 

  • When we make material changes, we will notify you (for example, via in-app notice, email, or our website).

  • Your continued use of the Service after the updated Terms take effect means you agree to them.

 

If you do not agree to the updated Terms, you must stop using the Service and may delete your account.​
